Shared right's termination
( co-ownershipcessation) means that the joint (shared) ownership of several persons over one property ends, and the property is divided in such a way that each either receives separate ownership, or one of them becomes the sole owner.
Simply put:
👉 Previously, the property belonged to several people together
👉 After termination — it is either divided, or one person retains it fully
Howdoes it happenSharedrighttermination
1. By agreement
If co-owners agree:
- The property is divided (e.g. land plot, apartment if technically possible)
- Or one of them buys the shares of the others
2. Through courtprocedure
If no agreement is reached, one of them can file a claim and request the termination of the shared right. The court then decides:
- Is it possible to divide the property in kind (actual division)
- If not — the property is sold (at auction) and the amount is distributed according to shares
- Or one co-owner is obliged to buy out the shares of the others
