The holder of a claim (creditor) may assign the claim to a third party without the debtor's consent, unless this contradicts the nature of the obligation, an agreement with the debtor, or the law (assignment of claim). An agreement with the debtor prohibiting assignment is permitted only if there is a legitimate interest of the debtor.

Assignment of a claim is effected by a contract concluded between the holder of the claim and the third party. In such cases, the third party assumes the position of the original holder.

Debtor's rights upon assignment of claim

Until the debtor is notified of the assignment of the claim, they are entitled to perform the obligation to the original holder of the claim.
