Article 341 of the Criminal Code punishes official forgery. In practice, this norm is often applied where, in fact, there is only an administrative error — and, conversely, sometimes it is not applied where all its elements are present. The difference is made by four elements.

1. Special subject

Only an official or a person equated thereto. The same act committed by a private person is not qualified under Article 341.

2. Two forms of action

  • Entering false information or record into an official document or register — that is, distorting the content of an existing document;
  • Drawing up and issuing a false document — that is, creating a forgery from scratch.

3. The document must be official

Object of protection It is the reliability of public document circulation. Forgery of a private document does not fall under this norm and should be sought in another composition.

4. Motive — the decisive element

This is the point where most cases are resolved. The act must be committed for gain or other personal motive. If this sign is not confirmed, there is no criminal composition — the remaining deficiency falls within the scope of disciplinary responsibility.

Gain implies material benefit; “other personal motive” is broader — career interest, acting in favor of a relative or acquaintance, covering up one's own shortcoming. But in both cases, this personal interest must exist and not departmental inertia or a technical error.

Distinction from neighboring articles

Article 362 (preparation-use of a forged document) differs by the subject: there, any person prepares or uses a fake document, while in Article 341 — an official, due to their official position.

With Article 332 (abuse of official authority) Article 341 is often combined — when a fake document is used as an instrument of exceeding authority. The charge is usually brought under both articles.

First line of defense: The prosecution must substantiate not only that incorrect data was found in the document, but also that its entry was made with intent or personal motive. A technical error, overload, incorrect internal instruction, or departmental practice does not constitute the offense. The position should be built on this distinction from the very first stage of the investigation.

Conclusion

Article 341 does not punish a mistake — it punishes an official acting out of personal interest. All four elements — special subject, form of action, official nature of the document, and motive — are cumulative. The absence of any one fully negates the qualification.

Therefore, the assessment of the case should begin precisely with the separate examination of these four elements.
