What is an employment relationship?

According to Article 2 of the Labour Code:

An employment relationship is the performance of work by an employee for an employer under conditions of organizational arrangement of labour in exchange for remuneration.

Who are the subjects of an employment relationship?

The subjects of an individual employment relationship are the employer and the employee.

Whereas, the subjects of a collective employment relationship are one or more employers or one or more associations of employers and one or more associations of employees.
 

On what grounds can an employment contract be terminated?

The grounds for termination of an employment contract include, for example:

• Organizational changes that necessitate workforce reduction;

• Expiry of the employment contract term;

• Resignation based on a written application;

• Written agreement between the parties;

• Incompatibility of qualification or professional skills with the work to be performed;

• Gross violation of obligations imposed by the contract;

• Death of the employer as a natural person or the employee;

• Other objective circumstance justifying the termination of the employment contract.

Dispute with the employer

The employer is obliged, within 7 calendar days from the submission of the request by the employee, to provide a written justification for the grounds of termination of the employment contract.

Within 30 calendar days from receipt of the employer's written justification, the employee may appeal the employer's decision on termination of the contract in court.
