Facts of the Case

On February 25, 2026, while crossing the state border of Georgia, I.G. was denied exit from the country without any legal justification. Notably, at that time, the individual held a lawful permit to travel abroad issued on the basis of Letter N2/05/6796 dated January 23, 2026, by the LEPL National Probation Agency.

Legal Issue

The action taken at the border was not issued in the form of an administrative-legal act, and the citizen was informed of neither the factual nor legal grounds for the refusal. This in itself constitutes a gross violation of procedural rules.

Inaction of the Administrative Body

Following the refusal, the client submitted a written request to the Ministry of Internal Affairs seeking clarification. No response was received. On April 13, 2026, a re-application was submitted — requesting the issuance of an administrative act. This application also remained unanswered. Leaving two requests unanswered constitutes “inaction of the administrative body” as defined by law.

Relief Sought

The court was requested to order the Ministry of Internal Affairs to issue a reasoned administrative-legal act — to provide the client with the opportunity for effective legal protection and to restore the freedom of movement guaranteed by the Constitution of Georgia.
