Non-payment for Supplied Goods — Lawsuit and Seizure of Factory

Factual Circumstances of the Case

From February 2 to February 15, 2023, LLC “B. A. Georgia” supplied LLC “S. B.” with 314,496 units of colorless (transparent) 1-liter glass bottles — for bottling wine. The delivery was completed fully and properly.

Breach of Obligation

The respondent received goods worth 451,317.50 GEL (four hundred fifty-one thousand three hundred seventeen and 0.50). Only 439,540.90 GEL was paid. As a result, the remaining value of the supplied goods — 11,776.60 GEL (eleven thousand seven hundred seventy-six and 0.60) — has not been paid by the respondent to date.

This constitutes a gross violation of a civil law obligation, which negatively affected LLC “B. A. Georgia’s” financial condition and operations.

Legal Measures Taken

To protect the client's interests, we undertook the following actions:

  • Filing a Lawsuit — a claim was filed with the court demanding payment of the outstanding amount — 11,776.60 GEL
  • Property Security — as a measure to secure the claim, we seized the enterprise (wine factory) of LLC “S. B.”, which prevents the respondent from disposing of the property until the decision is enforced

Conclusion

This case clearly demonstrates the importance of proper documentary formalization of commercial relations.
